Terms of Service

1. Agreement to Terms

By accessing or using FosterFlow ("the Service"), operated by FosterFlow ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including administrators, staff members, volunteers, and applicants who interact with a rescue organization's FosterFlow site.

2. Description of Service

FosterFlow is a hosted software-as-a-service (SaaS) platform providing rescue management tools for animal rescue organizations. Features include pet record management, foster portals, adoption and foster applications, donation tracking, event management, content management, and related functionality as described on our Features page.

Each subscribing organization ("Tenant") receives a dedicated instance of the platform at a subdomain of fosterflow.app (e.g., yourrescue.fosterflow.app) or optionally at a custom domain.

3. Accounts and Registration

To use the Service, an organization must submit a signup application. We review all applications and reserve the right to accept or reject applications at our sole discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach at hello@fosterflow.app.

You represent that you are authorized to enter into this agreement on behalf of your organization, and that the information you provide is accurate and complete.

4. Subscription, Billing, and Payment

FosterFlow offers subscription plans billed monthly or annually. Current pricing is available on our Pricing page. Prices may change with 30 days' written notice.

Your subscription begins after your free trial period ends. You authorize us to charge your payment method on a recurring basis until you cancel. Billing occurs at the start of each billing cycle (monthly or annual).

All fees are in US dollars and are non-refundable except where required by law or at our discretion. If we fail to provide the Service in accordance with these Terms, you may request a prorated refund for the affected period.

Failure to pay will result in suspension of your account. Accounts suspended for non-payment retain data for 30 days, after which data is deleted.

5. Free Trial

New accounts begin with a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue using the Service. Trial accounts that do not subscribe will have their data deleted 14 days after trial expiration.

6. Data Ownership

You retain full ownership of all data you upload or create within the Service, including but not limited to pet records, application data, donor information, and content ("Your Data").

You grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you. We do not sell, rent, or share Your Data with third parties except as necessary to deliver the Service (e.g., email providers, payment processors) or as required by law.

You may export Your Data at any time through the admin dashboard. We provide export functionality in standard formats (CSV). Upon account termination, you have 30 days to export Your Data before it is permanently deleted.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You must not use the Service to store, transmit, or process any data in violation of applicable laws, including but not limited to laws governing personal data, animal welfare, and nonprofit fundraising.

8. Uptime and Service Level

We target 99.5% monthly uptime for the Service, excluding scheduled maintenance. Scheduled maintenance will be announced at least 24 hours in advance when possible.

We do not provide a formal Service Level Agreement (SLA) or uptime guarantee. In the event of an extended outage (more than 24 consecutive hours), we will provide a prorated credit at our discretion.

9. Backups

We perform daily automated backups of all tenant data. Backups are retained for at least 7 days. While we take reasonable measures to protect your data, we recommend that you maintain your own exports of critical data. We are not liable for data loss beyond what can be restored from backup.

10. Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms.

11. Intellectual Property

The Service, including its source code, design, and documentation, is open source and licensed under the MIT License. The FosterFlow name, logo, and branding are owned by us and may not be used without written permission.

You retain all intellectual property rights in Your Data and any content you create using the Service.

12. Cancellation and Termination

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You retain access to the Service through the end of your paid period.

We may terminate or suspend your account immediately, without prior notice, if you violate these Terms or our Acceptable Use Policy, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. We will retain Your Data for 30 days following termination, after which it will be permanently deleted.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall FosterFlow be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or business opportunity, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising under or in connection with these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim.

14. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

15. Indemnification

You agree to indemnify, defend, and hold harmless FosterFlow and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration, except for claims seeking injunctive relief, which may be brought in a court of competent jurisdiction.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by email to the address on file for your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
